About this PROHIBITED & RESTRICTED PRODUCTS POLICY. This Policy covers the rules, obligations, and rights that apply to this policy on the Upmos marketplace. Read the full text below; by using our Services you agree to comply with it.

In Plain English (Non-Binding Summary)

Certain product categories are absolutely prohibited on Upmos (firearms, controlled substances, counterfeit goods, CSAM, ivory, etc.) and others are restricted with category-specific compliance requirements (alcohol, tobacco, hazmat, medical devices, supplements). Listing a prohibited item is grounds for immediate listing removal and possible account termination. Restricted items require pre-approval and documentation.

Overview

This Policy lists product categories that may not be sold on the Upmos marketplace, and others that require pre-approval, documentation, or special handling. Sellers are responsible for verifying their listings comply with this Policy and all applicable federal, state, and local laws.

Absolutely Prohibited Items

  • Firearms, ammunition, suppressors, and assault weapons.
  • Explosives, fireworks rated above 1.4G, military ordnance.
  • Schedule I-V controlled substances and prescription drugs.
  • Drug paraphernalia primarily designed for use with illegal substances.
  • Child sexual abuse material (CSAM) or any sexualized depiction of minors.
  • Counterfeit, replica, knock-off, and trademark-infringing goods.
  • Ivory, rhino horn, sea-turtle products, and CITES-listed endangered wildlife.
  • Human remains, organs, or fluids.
  • Stolen property.
  • Items that promote terrorism, organized crime, or human trafficking.
  • Items prohibited by U.S. OFAC sanctions (see OFAC Region Block).

Weapons & Firearms

All firearms, ammunition, magazines (regardless of capacity), suppressors, and 80% / “ghost gun” kits are prohibited. Non-firearm weapons such as pepper spray, stun guns, knives over 4-inch blade, and brass knuckles are restricted by state; sellers must geo-block jurisdictions where the item is illegal.

Drugs, Supplements & Paraphernalia

  • Prescription pharmaceuticals (controlled or non-controlled) are prohibited.
  • Recreational cannabis, marijuana, THC products are prohibited.
  • CBD products are restricted — only hemp-derived (Farm-Bill-compliant) products listed by verified sellers with COA documentation are permitted.
  • Kratom is restricted by state; sellers must geo-block prohibited jurisdictions.
  • Dietary supplements must comply with FDA / FTC labeling and disclaimer rules.
  • Drug paraphernalia (bongs, dab rigs, etc.) is prohibited when primarily designed for illegal use; tobacco-only paraphernalia is restricted.

Counterfeit, Replica & Trademark

Any item that is not genuine but is presented as if it were genuine is prohibited. This includes “1:1 replica,” “AAA quality,” and “inspired by” listings for trademarked brands. Suspected counterfeit listings are referred to the Brand Registry team and may trigger an immediate account hold pending investigation.

Adult Content (Restricted)

Adult novelty items, intimate apparel intended for adults, and unrated/explicit media are restricted to age-gated listings only. Pornography, sex-work services, and live-stream adult content are prohibited.

Hazardous Materials

Items classified as Hazmat by the U.S. DOT (lithium batteries above standard cells, flammable liquids/aerosols, corrosives, oxidizers, certain magnets) are restricted to sellers enrolled in the Upmos Hazmat program. See the Hazmat Shipping Policy for details.

Alcohol, Tobacco & Vaping (Restricted)

Beer, wine, and spirits are restricted to alcohol-licensed sellers in states permitting direct shipment. Tobacco products are restricted under the PACT Act; vaping products are restricted further under the federal Preventing All Cigarette Trafficking (PACT) Act and require age-verification at delivery.

Ivory & Endangered Wildlife

Ivory, rhino horn, sea-turtle shell, and any product made from a CITES Appendix I species are absolutely prohibited regardless of age claim. CITES Appendix II/III items require export and import permits which sellers must furnish before listing approval.

Medical Devices

FDA Class I (low-risk) medical devices may be listed by sellers with current FDA establishment registration. Class II and III devices are restricted; prescription-only devices are prohibited.

Food & Supplements

Packaged food must include proper FDA nutrition labeling. Allergen disclosure is mandatory. Supplements must include the FDA “Supplement Facts” panel and any required FTC disclosure on health claims. Unpasteurized dairy / juice and unregistered infant formula are prohibited.

State-Specific Restrictions

Sellers must implement geo-restrictions (“geo-blocks”) for items restricted in specific states — e.g., kinder eggs (FDA), certain laser pointers (NY, CA), 30+ round magazines (multiple states), e-bike classifications, fertilizer concentration limits (post-Oklahoma City regulations).

Enforcement

Prohibited listings are taken down on detection. Sellers receive a violation notice and may have inventory destroyed at their cost when contraband. Repeated violations result in escalating account actions:

  1. First violation — listing removed + warning.
  2. Second violation within 90 days — 30-day listing suspension.
  3. Third or any prohibited-category violation involving criminal contraband — permanent termination + referral to law enforcement.

Reporting Prohibited Listings

Anyone can report a suspected prohibited listing via “Report this listing” on the product page or by emailing report@upmos.com. Reports are reviewed within 24 hours; emergencies (CSAM, weapons offered for direct delivery) are escalated immediately to law enforcement.

Governing Law & Jurisdiction

This Policy is governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to this Policy that cannot be resolved through our internal process shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Houston, Harris County, Texas. You and Upmos each waive the right to a jury trial and the right to participate in any class-action or collective proceeding.

If arbitration is found unenforceable or inapplicable to a particular claim, you agree that any legal action shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you irrevocably consent to the personal jurisdiction of those courts.

If any provision of this Policy is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision shall not constitute a waiver. This Policy, together with our Terms of Use, constitutes the entire agreement between you and Upmos with respect to the subject matter herein.
